This position shall serve as a Chief Legal Counsel in the office of General Counsel, overseeing and assisting the Bureau of Human Relations, Equal Opportunity Office, Public Records Office, the Office of the Inspector General and serves as the Department’s Ethics Officer.The incumbent is responsible for overseeing human resources litigation across all divisions of the State Health Office of the Department of Health, supporting the 67 County Health Departments and supervising the Public Records Office. The position requires excellent research and writing skills, experience guiding clients and supervising attorneys and support staff. The incumbent will be expected to communicate effectively with clients in a timely and efficient manner with the flexibility to handle matters in an expedited manner. The primary responsibilities of this attorney will be:
Represents the Department of Health in administrative matters before the Division of Administrative Hearings and Public Employees Relations Commission and in civil matters in state and federal courts.
Conducts legal research to support the litigation positions of the Department.
Drafts complaints, settlement agreements, proposed recommended orders, briefs, motions, discovery, and various pleadings.
Reviews and advises on legal sufficiency of proposed disciplinary actions.
Provides legal advice on ethics questions and reviews and advises on ethics issues related to dual and outside employment.
Prepares witnesses, advises investigators, and consults with clients on litigation matters.
Examines and interprets laws, rules and regulations to determine advisability of supporting or defending litigation.
Confers with colleagues with specialized legal expertise.
Attends meetings and provides legal counsel for the assigned programs.
Handles special projects as assigned.
Conducts risk-assessment of complaints and develops sound legal strategies for the Department.
Performs other duties as required by General Counsel and Deputy General Counsel.
Travel is occasionally required.
