EPC client in Houston involved in heavy industrial plant engineering & construction projects is looking for someone to head up their Commercial Contract Management department. You need 10-25+ years of experience managing & leading commercial and legal support during sales, proposal and execution phases for industrial, heavy industrial or manufacturing related EPC projects.

responsibilities:

Your main responsibility will be to manage the commercial and legal aspects of contracts for heavy industrial plant EPC projects

You will be responsible for controlling commercial risk while optimizing project cash flows and project results

You will be responsible for negotiations of favorable terms and conditions in client contracts, analyzing commercial cost drivers & identifying mitigation measures, pro-active support of change order notifications & claim negotiations with clients, and accurate & timely invoicing and collection of project payments

Lead initial proposal/contract review to include leading the commercial proposal process and document, T&Cs, project risk review, client credit risk for payment collateral, foreign exchange risk, internal collateral requirements, and ensuring contract flow-down through supply chain

Spearhead review and negotiation of contract terms and conditions including comparison to the Global Minimum Requirements, i.e. contract essentials checklist and clear communication of key liability provisions to leadership

Coordinate multi-functional department activities as well as regional counterparts for legal, insurance and tax implications to achieve timely delivery of contract negotiation and support

Lead project execution contract management activities such as hosting the commercial kick-off meeting, support project manager in commercial and project legal matters, identify/document commercial and legal risks during project execution, and develop action plans to mitigate

Deliver change orders & claims management process to include proactively pursuing preparation, submission, and negotiation of change orders/claims in cooperation with Project Manager

Establish Contract Management policies, ensure compliance and verify appropriate work instructions are created and/or modified for ISO Quality requirements.

Manage department budget and controls expenses effectively

Hire, train, develop, and manage a department of 5+ Contract Specialists

 

qualifications:

10+ years of experience managing & leading commercial and legal contract management during sales, proposal and execution phases for industrial, heavy industrial or manufacturing related EPC projects

You must have the majority of your contract management experience on the front end of the contract negotiations for these projects

The ideal candidate has a Juris Doctorate (JD) Law degree, but the client will accept other Bachelor's degrees

You need to have a strong background in a commercial environment

You need at least 3 years of management experience

You need experience identifying & managing commercial risk as well as minimizing associated consequences for these projects

Experience with and understanding of EPC contract requirements is preferred

You need experience with change orders & claims management in support of these projects

Effective negotiation, analytical and problem-solving skills

Excellent business acumen and genuine understanding of business administration and economical context

Effective communication skills both verbally and in writing with superiors, colleagues, and individuals inside and outside the Company
